1. Agreement to Terms

By downloading, installing, or using the Vamooos mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to update these Terms at any time. We will notify you of significant changes through the App. Continued use after changes take effect constitutes your acceptance of the updated Terms.

2. Eligibility

To use Vamooos, you must:

• Be at least 16 years of age
• Have a valid phone number capable of receiving SMS or WhatsApp messages
• Be located in or have a legitimate purpose to use services available through the App
• Not have been previously banned or suspended from Vamooos
• Not be prohibited from using the App under applicable law

By using the App, you represent and warrant that you meet all eligibility requirements above. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

3.1 Creating an Account

You register using your phone number and a one-time verification code (OTP). You must provide accurate information and keep your profile up to date.

3.2 Account Security

Your account is tied to your phone number. You are responsible for:

• Maintaining the security of your phone and number
• All activity that occurs under your account
• Notifying us immediately if you suspect unauthorized use of your account

3.3 One Account Per Person

Each person may maintain only one active account. Creating multiple accounts to circumvent bans or restrictions is prohibited.

3.4 Guest Access

The App offers limited guest access without registration. Guests cannot make bookings or access all features. Guest sessions are temporary and not linked to any persistent account.

4. The Vamooos Platform

4.1 What Vamooos Does

Vamooos is a marketplace platform that connects customers ("Players") with sports field owners ("Owners"). We provide the technology platform; we are not a sports venue operator and do not own any fields listed on the App.

4.2 What Vamooos Does Not Do

• We do not guarantee the quality, safety, legality, or accuracy of any field listed
• We do not guarantee that bookings will be fulfilled by field owners
• We are not a party to the agreement between a Player and an Owner
• We are not responsible for any disputes between Players and Owners

5. Bookings

5.1 Making a Booking

When you submit a booking request, it is sent to the field owner for confirmation. A booking is not confirmed until the owner accepts it. You will receive a notification when a booking is confirmed or declined.

5.2 Payment

All payments are made in cash directly at the field at the time of the booking. Vamooos does not process or hold any payments. You agree to pay the amount agreed upon at the time of booking.

5.3 Cancellations

• Players: You may cancel a booking up to 2 hours before the scheduled start time. Cancellations within 2 hours of the booking time may not be eligible for rescheduling.
• Owners: Owners may cancel or decline bookings at their discretion. Repeated unjustified cancellations by owners may result in their account being reviewed.
• Vamooos is not responsible for compensation in the event of a cancellation by either party.

5.4 No-Shows

Failing to attend a confirmed booking without cancelling is a no-show. Repeated no-shows may result in warnings, temporary restrictions, or permanent account suspension at our sole discretion.

5.5 Recurring Bookings

Monthly recurring bookings create 4 separate weekly booking requests. Each booking is subject to individual confirmation by the field owner. Cancelling one booking in a recurring series does not automatically cancel the others.

6. Field Owners — Additional Terms

If you use Vamooos as a field owner, the following additional terms apply:

6.1 Listing Accuracy

You are solely responsible for the accuracy of your field listings, including name, location, photos, price, availability, and operating hours. Intentionally misleading listings may result in immediate account suspension.

6.2 Confirmation Responsibility

You are expected to respond to booking requests promptly. Consistently failing to confirm or decline bookings within a reasonable time may result in your account being restricted.

6.3 Field Condition

You are responsible for ensuring your field is safe, clean, and in the condition described in your listing on the booked date and time.

6.4 External Bookings

The "Block Slot" feature allows you to mark time slots as unavailable for customers booked from outside the App. Misuse of this feature to artificially inflate occupancy or deceive customers is prohibited.

6.5 Revenue and Pricing

You set your own prices. Vamooos does not take a commission or fee from bookings at this time. We reserve the right to introduce a service fee in the future with advance notice to field owners.

7. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any local laws
• Impersonate any person or entity, or provide false information
• Harass, abuse, threaten, or intimidate other users
• Post or transmit offensive, defamatory, or inappropriate content
• Manipulate reviews or ratings
• Use bots, scrapers, or automated tools to access the App
• Attempt to gain unauthorized access to our systems or another user's account
• Use the App to send spam or unsolicited commercial messages
• List fields you do not own or have authority to list
• Book fields with no intention of attending (serial no-shows)
• Create fake accounts or use the App to circumvent a ban

Violation of any of these prohibitions may result in immediate account termination and, where appropriate, referral to law enforcement.

8. Content and Reviews

8.1 Your Content

You retain ownership of content you upload (profile photos, field images, reviews). By uploading content, you grant Vamooos a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content within the App and in our marketing materials.

8.2 Content Standards

All content you post must be:

• Truthful and not misleading
• Free of offensive, discriminatory, or inappropriate material
• Not infringing on any third-party intellectual property rights

8.3 Reviews

Reviews must be based on genuine first-hand experience. We reserve the right to remove reviews that we determine, at our sole discretion, to be fake, abusive, or in violation of these Terms.

8.4 Our Rights Over Content

We reserve the right to remove any content that violates these Terms or that we determine, at our sole discretion, to be harmful to users, field owners, or the platform.

9. Intellectual Property

The Vamooos name, logo, app design, source code, and all associated intellectual property are owned by Vamooos and protected by applicable intellectual property laws. You may not:

• Copy, modify, or distribute our app or its content without written permission
• Reverse engineer or attempt to extract the source code of the App
• Use our trademarks, logos, or branding without prior written consent

10. Disclaimers

The App is provided "as is" and "as available." To the fullest extent permitted by law:

• We make no warranties, express or implied, about the reliability, accuracy, or availability of the App
• We do not guarantee that the App will be uninterrupted or error-free
• We are not responsible for the conduct of any user, field owner, or third party
• We are not responsible for any field that fails to meet your expectations or is unavailable despite being listed
• We are not responsible for any injury, loss, or damage occurring at a sports field booked through the App

Use the App at your own risk.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Vamooos shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of data, profits, revenue, or business opportunities
• Any personal injury or property damage arising from your use of a field booked through the App
• Any damages resulting from unauthorized access to your account
• Any damages exceeding the amount you paid to us in the 12 months preceding the claim (which in most cases will be zero, as the App is currently free)

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Vamooos and its officers, employees, and agents from any claims, damages, losses, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you post or transmit through the App

13. Account Termination

13.1 Termination by You

You may delete your account at any time through the App (Settings → Delete Account). Upon deletion, your data is permanently erased in accordance with our Privacy Policy.

13.2 Termination by Us

We reserve the right to suspend or permanently terminate your account at our sole discretion, with or without notice, if we determine that you have:

• Violated these Terms
• Engaged in fraudulent, illegal, or harmful activity
• Repeatedly failed to honour bookings
• Created a negative experience for other users or field owners

13.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Pending bookings will be cancelled and relevant parties notified.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Libya.

Any disputes arising out of or related to these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. Contact us at [email protected] to initiate this process.

If we cannot resolve a dispute through negotiation, it shall be submitted to the courts of Libya.

15. Third-Party Services and Links

The App integrates third-party services (Google Maps, Twilio, Firebase). Your use of these services is subject to their own terms and privacy policies. We are not responsible for the practices of these third parties.

16. Changes to the App

We reserve the right to:

• Modify, suspend, or discontinue any feature of the App at any time
• Introduce new features or pricing structures with notice
• Change or remove fields listed by owners at our discretion for policy violations

We will make reasonable efforts to notify you of significant changes that affect your use of the App.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vamooos regarding your use of the App and supersede all prior agreements.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
